My name is James Brooks,
On 8/13/20 I was incarcerated by Saginaw County Michigan for multiple felonies stemming from an incident alleging home invasion, sexual assault, and robbery.
Since day one I've told police, attorneys, and the trial Judge that "I DIDN'T RAPE ANYONE" and that I'm not being treated fairly due to the horrific nature of the accusations. Furthermore, due to my counsel failing to advocate for me or discover and present the exculpatory DNA evidence, the continued threats of an alleged co-defendant that would blame me to receive a “prosecutor’s deal”, the continued threats guaranteeing me a LIFE sentence if I didn’t plead, and my lack of legal knowledge, I plead no-contest and was sentenced to 25 felonies and received 55 to 80 years.
By the grace of God, in 2021 Darrell Siggers and attorney Laura Sutton helped me obtain my Saginaw county prosecutor’s file which contained EXCULPATORY evidence that had been withheld since 2014. Included was a forensic report proving the police took swabs 10 minutes after the incident alleged. None of my DNA swabs matched the victim’s (excluding me from sexual assault), nor did my swabs match the guns found near the crime scene. Withholding this exculpatory evidence is not only a Brady Violation, but it denied my right to present a meaningful defense and my right to fair proceedings.
In addition to them withholding the exculpatory DNA evidence, I was appointed an ineffective appellate attorney in 2015, who withdrew from my case two months later, simply stating he couldn't help me. The trial court has never reappointed appellate counsel to this day, thereby violating my appellate rights, and the right to be represented by effective appellate counsel.
I’ve had time to reflect, and I regret the wrongs of my past, which has led me to broaden my moral, mental, and spiritual strengths over the years. I now fathom and understand the power of words like perseverance, Justice, Truth, Hope, and God.....I have been married seven years now, and my wife and children who come to see me regularly, need me dearly.
