In September 1995 I was wrongfully convicted of 1st Degree Murder/Felony Firearm. My Intent remains to not waste anyone's time, but I've been in DIRE need of help for 28 years and I need help. I know my case is laden with illegality on the part of those who are supposed to uphold the law, but my greatest obstacle has been retrieving my entire paperwork package, as it stands now I have the advocacy group Humanity For Prisoners helping to retrieve my paperwork.
First off, I was originally taken into custody on Sept. 1st, 1994 at the preliminary of a V.C.S.A. charge for the Murder that I'm now convicted of, which happened days prior. At the time of my case, unbeknownst to me, Frederick Williams(DECEASED), who originally wanted to plead the 5th in my trial under the advice of his attorney Mark Brown, but then, was given immunity to testify in my case, and whose original statements never implicated me in any way(Please Note: Statements taken by Sgt. Jo Ann Kinney and Donald Stawiasz), as well as some of his trial testimony, but in fact identified my codefendant Joseph Dewayne Black, who was not in custody, as the shooter, but after police coercion, I was NOW a shooter. This is why I've been eagerly trying to get my entire PACKAGE, to see if there has been a pattern with witness statements coercion by any of the Detectives involved in my case, among other things.
The other "EYEWITNESS", Dennis Cameron(DECEASED) and Frederick Williams fabricated testimony conflicted on every level during my trial. The driver, Williams, said that Joseph Black was in the front next to him and placed me in the backseat, never in the front. Dennis Cameron testified that there was one shooter and that was the person in the front passenger seat, OF A TWO-DOOR car. My trial lawyer at the time was David Braxton, who is now a judge at 36th District Court. By being ignorant of law at the time I waived witnesses under the advice of this man. Those witnesses were, Sgt. Charles Davis, Sgt. Jo Ann Kinney, Officer David Huggins. Though I cannot predict what could have happened had these people testified, I know now that by David Braxton advising me to not have them testify may have hurt my chances at freedom, and that is Ineffective Assistance of Council. I'm truly in a fight for my life and I need help. I'm not an expert of legalese, but, I can assure that this is not a con nor a scam and with the proper help I can be truly vindicated.
To further plead my case, I AM WILLING TO TAKE A POLYGRAPH TEST, for anyone who may be interested in my plight. I make myself available to this process not because it may be admissible in the legal world or not, but to show that I am being truthful about my Innocence. For those who read this and for whatever reason may not be interested, I ask that you please bring it to the attention to someone that may be willing to help an Innocent man regain his freedom.
