My case arose from accusations that I sexually abused my son RH and daughter JH. I was originally charged with three counts concerning RH and two counts relating to JH. The two charges relating to JH were dismissed by the prosecution. Following a jury trial, I was convicted of two counts but acquitted of the third. I was sentenced to 25 to 50 years and have served more than 21 years.
On 3/17/2011, I received a letter from RH admitting he lied at trial regarding his accusation against me and acknowledged that I'm innocent. On 11/30/2011, RH submitted an affidavit declaring that I am innocent, that a man named James Todd Cook is who molested him, and that he informed authorities before trial that Mr. Cook sexually abused him and not me.
On 3/18, 2018 certified legal investigator Leonard Accardo completed his investigation of my case, which included interviews of RH, JH, foster mother Kelly Glenn, and James Todd Cook.
Beginning with Ms. Glenn, who appeared to be very candid, explained she believed RH and JH had experienced some type of sexual abuse. She initially believed I was the only adult male to have contact with them. Naturally, she believed I was the only possible suspect. She later learned from the prosecutor of another suspect, James Todd Cook. Ms. Glenn reported RH and JH had several contacts with their mother Denise & her sister Robin. Ms. Glenn is certain Denise & Robin did everything imaginable to manipulate RH & JH to speak out against me and encouraged them to testify against me. They were vindictive towards me and blamed me for all their troubles, Glenn said.
JH told Mr. Accardo that she is beyond certain that I am innocent and the only adult that improperly touch her was Mr. Cook. She recalls specific details regarding how Mr. Cook placed his mouth on her vagina. JH submitted an affidavit.
Mr. Accardo interviewed Cook in prison where he is serving time for molesting young children. He denied molesting RH or JH. However, he explained his sexual preference which included him placing his mouth on young girls vaginas. Cook, who frequently resided in our home also told Mr. Accardo there was no way I molested RH or JH. He was adamant. He also recalled having a conversation with the prosecutor regarding the case against me and informed her there was no way I was guilty of molesting RH or JH. Cook reported that my ex-wife Denise was very vindictive toward me and did many bad things to me out of spite, which included having sex with Cook.
Mr. Accardo discovered the police detective in my case admitted his police reports and investigation of my case were incomplete and inaccurate. Mr. Accardo found that admission frightening at best.
The very real possibility of someone other than me being the actual perpetrator demands further inquiry. The numerous uncertainties described by persons directly involved overwhelmingly point to and go beyond all known parameters regarding reasonable doubt.
I'm looking to retain an attorney. My previous attorney, David L. Moffitt, passed away, and my currently filed MCR 6.502 motion has been filed since 03/15/2019. It has recently been brought to my attention that Oakland County is or has formed its own conviction integrity unit. I would like them to have my profile.
