My name is DeAmo Lately.
I was convicted of home invasion, armed robbery, and felony firearm and sentenced to 10 yrs. I was falsely identified as a suspect in these crimes due to unduly suggestive identification procedures, including when corrupt detectives on my case showed photos of me to the victim although she had already positively identified 2 men whom she knew as the suspects that robbed her. Also, I was placed in a live lineup where she asked the same detectives how sure she had to be? They then asked her if she was picking the person in spot #4 which happened to be me.
I have an identification expert’s report to support my claim as well as a recorded interview with the victim where she states she never identified me from a photo lineup, although the detectives report said she did.
I am also laboring under an unlawful plea as I was never advised of the maximum possible sentence because they never notified me the 2-year gun charge is mandatory consecutive to the 8-year Home Invasion.
